Passing your tenancy on

You can pass on your tenancy to your children, husband, wife or partner. This is called the Right to Succession. Your tenancy can only be passed on once in this way. If you are a joint tenant or you're married and your spouse or partner dies, you will become the sole tenant and this will count as succession. 

Your right to inherit a tenancy will depend on:

• your relationship with the tenant
• the type of tenancy they had
• when the tenancy started

The tenancy you inherit will be the same type as that of the person you inherited it from. You are likely to pay the same rent and service charges and have the same rights. 

When applying to inherit a tenancy you will be asked to provide:

• evidence of who you are,
• evidence of your relationship to the tenant who died,
• evidence that you've lived there for the last 12 months.

If you continue to live in a home of the person who died without formally inheriting the property, we will take steps to evict you from the property.
